Home Retention Program

At The Illinois Law Group, we will work with your bank to modify your current mortgage, which will enable you to retain your home.  While other loan modification companies use negotiators who lack the qualifications to full represent you, The Illinois Law Group will provide you with an attorney personally dedicated to obtaining a loan modification that will fit your financial situation.  As your attorneys, The Illinois Law Group will maintain the highest ethical and customer service standards and will zealously represent you so that you feel safe and confident that you have taken every step to keep your home.

Short Sale Negotiations

As a loan modification may not help all individuals with their financial situation,  The Illinois Law Group  will work with your bank and realtors to negotiate a short sale.  A short sale is one way for homeowners to take the initiative in controlling their financial situation.  At The Illinois Law Group, we will work diligently and thoroughly to make sure that you are protected from any deficiency judgment that would otherwise be entered against you and ensure that you receive the highest tax protection for any forgiven debt.

Deed in Lieu of Foreclosure

In the unlikely event that you cannot find a buyer for your short sale, The Illinois Law Group will negotiate a deed in lieu of foreclosure with your lender.  As an alternative to a short sale, a deed in lieu of foreclosure is a vehicle to protect yourself from  from any deficiency judgement that would be otherwise entered against you.

Foreclosure Defense Litigation

Many individuals who are in need of The Illinois Law Group’s services with respect to a loan modification, short sale, or deed-in-lieu of foreclosure also face the prospect of a foreclosure lawsuit being filed against them.  It is imperative that any professional who assists you in a loan modification, short sale, or deed-in-lieu of foreclosure also have the necessary qualifications and skill set to represent you in the pending foreclosure in order to meet your objectives.  We at The Illinois Law Group realize this necessity and will represent our clients in the foreclosure lawsuit while we achieve your other legal needs.  In addition, some individuals are victims of predatory lending, ILG will ensure that all your legal rights are vindicated to prevent the foreclosure aftermath of predatory lending.

Bankruptcy

The attorneys in our bankruptcy and insolvency litigation practice  have experience working on behalf of both creditors and debtors, allowing us to offer a unique, strategic perspective to our clients.

We handle Chapters 7, 11 and 13 proceedings in bankruptcy courts as well as non-bankruptcy insolvency proceedings related to state common law.

These highly sensitive proceedings require careful attention to detail and efficient use of resources.

Credit Card Settlement

Debt collection efforts are strictly regulated by State and federal law and set forth permissible and non-permissible methods for debt collectors when collecting consumer debt. For example, the collector is not allowed harass you or contact you at inconvenient times or places after being told to stop. Although violations of these laws do not “wipe away” legitimate debts, such violations do require mandatory monetary reward to you of up to $1,000, plus actual damages, plus reasonable attorney fees and court costs paid by the collector if you prevail.

At The Illinois Law Group, we will work with your creditors to settle your debts for cents on the dollar.  Unfortunately, many of ILG clients are the victims of unfair lending and violations of the fair debt protection act.  Given the often overbearing tactics of debt collectors, The Illinois Law Group will work to stop the harassing telephone calls and help take control of your financial situation.

The Illinois Law Group’s real estate attorneys work with developers, landlords and tenants to complete leasing transactions, which include ground leases, in-line shopping center leases, freestanding building leases, and office, industrial and warehouse leases. We work with residential, commercial and industrial building tenants to evaluate their space needs and future rights to renew, expand, contract and/or terminate.

Land Trust

There are many benefits to holding title to your land in a land trust, including probate avoidance for land. Because the trust agreement governs the ownership of the property and not a will, the property will not be included in your probate estate (although it will be included in your estate for estate tax purposes). As such, the long time delay inherent in probate will not apply and title to the land vests immediately upon the death of the beneficiary. We, at The Illinois Law Group, will draft the proper land trust agreement to meet each of your objectives in holding your real estate.

Mechanics Lien Litigation

The Illinois Law Group has represented subcontractors and material suppliers seeking to collect from general (original) contractors, general contractors, excavators, carpenters, surveyors, HVAC, plumbers, and seeking payment from property owners, and property owners who dispute the lien’s place against their property.
